EVIDENCE ADMISSIBLE-COURT 

Maseru, Mar.18—The High Court through Justice Maliepollo Maketha has on Monday, in a case in which two politicians, former army commander and the army members are among others charged with treason, ruled that evidence by the first crown witness is admissible. 

The ruling was made after the defence raised an objection on the evidence of Mr. Tanki Mothae. They argued that the evidence is hearsay therefore not admissible. They added that it is not an executive statement, further adding that it is irrelevant and prejudicial to the accused.  

Mr. Mothae who is a former member of the Lesotho Defence Force (LDF), former Principal Secretary in the Ministry of Defence, former Director-Organ on politics, Defence and Security Affairs at Southern African Development Community (SADC) Secretariat and former Principal Secretary in the Ministry of Local Government, Chieftainship, Home Affairs and Police responsible for policing, had testified that Tumo Lekhooa who was the army’s Head of Intelligence and Ntlele Ntoi who was from the army’s Public Affairs Office visited him in February 2014 while he was in Botswana.
