Maseru, Dec. 04 — The High Court has on Wednesday heard arguments in the Mohale Dam Murder Trial which is currently in a trial within trial.
When addressing the court, legal representative for the prosecution Advocate Motene Rafoneke stated that the allegations by the accused that they were unduly influenced by the police to make confessions, admissions and pointing outs, are not true. He emphasised that they did all freely and voluntarily.
He argued that the evidence of the accused was rehearsed, thus not credible adding that it should not be believed. He asked the court to take the confessions, admissions and pointing out by the accused as admissible.
The defence through one of its lawyers Adv. Letuka Molati, stated that procedure requires that records be made during pointing outs. He indicated that the investigating officers in this case who were aware that they were duty bound to follow the procedure did not however do it.
