ACCUSED WAS UNDER STATUTORY DUTY 

         
Maseru, Sept.10 — The defence in a murder case against five army members who are alleged to have killed three men at Mafeteng in 2012 insist that one of the accused Litekanyo Nyakane was under statutory duty to report when he made a statement to his superior about the incident which led to the death of the deceased in the matter. 

The argument was made before court on Tuesday in a trial within trial which was conducted after they raised an objection challenging admissibility of the evidence of Major General Ramanka Mokaloba. 

Major General Mokaloba has in the main trial testified that Nyakane had called him and given him the report about the alleged incident. In order to prove their case, the prosecution led him as their only witness in the trial within trial and closed their case while the defence decided not to call any witnesses. . .
